A Senior Associate with over 5 years of experience, he has effectively handled multifaceted litigation disputes including successfully representing one of the leading telecommunications service providers in Kenya at the Communications and Multimedia Appeals Tribunal in which he secured the stay of imposition of a fine in excess of Kshs. 400 Million. Isaac also represented a major Kenyan Airline in an employment dispute, succeeding at the Court of Appeal in reversing an award of reinstatement and more than Kshs. 144 Million award in damages.
He has made his contributions to jurisprudence in several instances, recently being part of the team that successfully represented several local bottlers against a contentious tax demand by Kenya Revenue Authority on returnable containers. He further advised a financial institution on the scope of its duties regarding fraudulent bills of exchange and the emerging jurisprudence on the subject within and outside Kenya. In the commercial sector, he successfully defended a claim against a brokerage firm registered against it with the Capital Markets Authority. He also took part in designing the Human Resources Manual and Code of Conduct for one of the firm’s clients in the manufacturing sector.
In his growth in the arbitration practice, Isaac has been the assisting Counsel in a construction arbitration dispute for breach of Project Management Agreement and succeeded in securing a favourable award to the client in excess of Kshs. 75 Million. He has further successfully reviewed the decision of a procuring entity at the Public Procurement and Review Board and secured an award to the client as the second-highest evaluated bidder. He has international experience, being part of the team that successfully represented a client at the Institute and Faculty of Actuaries (IFoA), United Kingdom against allegations of gross misconduct and integrity.
Isaac has vast experience in Alternative Dispute Resolution (ADR), is a Member of the Chartered Institute of Arbitration. In cognisance of this track record, it is only fitting that he is currently provisionally accredited as Mediator by Mediation Accreditation Committee established under the Kenyan Judiciary.
